CHAPTER 7 Bankruptcy

Chapter 7 bankruptcy is the option many individuals prefer because it essentially "wipes out" your debt.  Once you receive your discharge, your creditors* can no longer seek to collect what was owed prior to your filing.  Though there are a few exceptions, most of the debt we see at The Bowman Firm, P.C. is debt that can be discharged, if you qualify.


CHAPTER 13 Bankruptcy

If you do not qualify for a discharge in a Chapter 7 bankruptcy, you may still discharge you debt in a Chapter 13 bankruptcy, but this type of bankruptcy takes longer and requires you to make payments for an extended period of time.  The amount you would be required to pay during your Chapter 13 bankruptcy pay period depends on your disposable income after your basic needs are met. This process is more costly and takes a much longer time to complete, but it can ultimately help you to get back on track, so it does provide you with an option if Chapter 7 bankruptcy is not available to you.


* Some debt such as tax debt, government backed student loans or debt from a criminal disposition cannot be discharged in bankruptcy without very rare and/or extenuating circumstances.
